Move Up Cycling Club and Move Up Endurance Coaching Liability Waiver

Waiver and Release of Liability, Assumption of Risk, and Indemnity Agreement

In consideration of being allowed to participate in any way in the activities, events, or programs of Move Up Cycling Club and Move Up Endurance Coaching, including but not limited to cycling rides, training sessions, coaching, and other related activities (collectively, the “Activities”), I, the undersigned, acknowledge, appreciate, and agree that:

  1. Assumption of Risk
    • The risk of injury from the Activities is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist.
    • I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation.
  2. Release of Liability
    • I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.
    • I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless Move Up Cycling Club, Move Up Endurance Coaching, their officers, officials, agents, and/or employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the Activities (“Releasees”), with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law.
  3. Indemnification
    • I agree to indemnify and hold harmless the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in the Activities and to reimburse them for any such expenses incurred.
  4. Medical Treatment
    • I hereby release and forever discharge the Releasees from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with my participation in the Activities.
  5. Permission to Use Likeness
    • I grant to Move Up Cycling Club and Move Up Endurance Coaching all right, title, and interest in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by them during the Activities, for any purpose, including, but not limited to, promoting, advertising, or marketing.
  6. Severability
    • I expressly agree that this Waiver and Release is intended to be as broad and inclusive as permitted by the laws of the State of Kansas and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
  7. Acknowledgment of Understanding
    • I have read this Waiver and Release of Liability, Assumption of Risk, and Indemnity Agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.

For Participants Under 18 Years of Age

This is to certify that I, as parent/guardian, with legal responsibility for this participant, do consent and agree to his/her release as provided above, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these Activities as provided above, even if arising from their negligence, to the fullest extent permitted by law.
